UnitedHealth Group (NYSE: UNH) today announced that the U.S. District Court, Northern District of Illinois, Eastern Division has granted summary judgment in favor of UnitedHealth Group on all claims in the antitrust litigation with institutional pharmacy Omnicare, Inc.

"We have maintained throughout this litigation that UnitedHealth Group's dealings with Omnicare and its acquisition of PacifiCare were conducted in good faith and we are gratified that the Court agrees," said Peter H. Walsh, senior deputy general counsel of UnitedHealth Group. "Our goal then, as it is now, was to secure the best possible price on prescription drugs for seniors enrolled in our Medicare Part D program. We remain committed to providing these customers with affordable, quality health care and strong clinical and service value."

In the litigation, filed on May 18, 2006, Omnicare contended that UnitedHealth Group and PacifiCare Health Systems, prior to their merger, conspired in violation of the antitrust laws to obtain the lowest possible price from Omnicare for prescription drugs in connection with the Medicare Part D program. On June 20, 2008, UnitedHealth Group moved for summary judgment on all claims. On January 16, 2009, the Court concluded that all of Omnicare's claims lacked merit and granted summary judgment in favor of UnitedHealth Group.
